New York Regulators Vote to Allow Marijuana Farmers Markets While Nearly Doubling the Number of Provisional Retailer Licences

New York’s marijuana regulators approved a resolution authorizing cannabis farmers markets, where growers can sell their products and help meet consumer demand while the state is working to open more retail dispensaries.

The state Cannabis Control Board passed the measure Wednesday along with other resolutions focusing on enacting regulations on marijuana research, banning synthetic cannabinoids such as delta-8 THC, and other issues.

The board says that it wants the adult-use cannabis processors and cultivators to “bring [their product] to market, and to allow [conditional retailer] licensees sell such products at the same time.”

In municipalities that allow them, the plan is to host farmers markets-style events with “a minimum of 3 growers” as well as at least 1 licensed retailer.

The Department of Public Health will need to issue additional permits before allowing people to consume marijuana on the market. Organizers will also have to make sure that alcohol won’t be sold at events.

Farmers could theoretically apply for municipal approval to hold their farmers market on their property. They could also join events such as concerts, fairs or festivals.

However, the rules for the Farmers Market Program are not yet available. resolution authorizes OCM simply to send out an application to licensees who want to participate.

John Kagia, OCM’s Director of Policy, said that the showcases would offer many benefits to consumers. They will also provide them with access to regulated legal cannabis in areas where storefront sales are limited or not yet available. They’ll create new revenue opportunities for the cultivators, who are the backbone of our supply chain. We’ve heard from the cultivators that they’re eager to see this program expand retail sales.

The board also granted 212 additional provisional retailer licences, which is the largest batch of approvals ever. The total number of licensees in the state now stands at 463. The shops are expected to open in six to one year.

Tremaine Wright, CCB chairperson, said that the actions adopted by the board Wednesday will “help to close a few gaps and improve the operations of the cannabis supply chain.” “We will continue to edit, refine, and develop the program to ensure that it is as robust as possible,” said CCB Chair Tremaine Wright.

Only 20 adult-use retail stores are operating in the state. Many observers have criticized the slow rollout, which has resulted in delays in funding and storefront openings. The state is supposed to provide equity retailers with financing.

The resolutions also affect the state’s hemp and medical cannabis programs. This includes the adoption an emergency measures prohibiting the sale of synthetically-produced hemp cannabinoid items like delta-8 THC, and establishing a minimum limit of 15:1 CBD to THC for hemp products.

CCB passed a Measure for the revision of medical cannabis regulations, requiring that the terpene contents of marijuana products be included on labels. It also approved a Resolution that authorizes Coral Reef Labs as one of the independent cannabis testing laboratories in New York.

New York City officials announced Tuesday that they are looking for lenders to support a cannabis equity fund, which will encourage participation in the industry of people who have been disproportionately affected by criminalization.

launched a public awareness campaign in April to encourage adults to purchase marijuana from licensed stores to ensure the products are safe, and to use revenue to further equity and reinvestment objectives.

New York Senate also has a Committee that is solely focused on marijuana. This committee will work with regulators to help shape the cannabis market in New York.

In March, officials announced that they will double the number of adult-use cannabis licenses that are approved from 150 to 300. This was after certain applicants indicated that they could open their storefronts more quickly without any additional assistance through a program that is designed to assist eligible entities in creating physical locations.

As the state struggles with the regulation of the adult-use marijuana market, the governor recently introduced legislation that would increase enforcement authority in order to crackdown on illegal marijuana retailers.

Hochul unveiled separately in December a tool for verifying marijuana businesses and products. The plan is to place a QR code at licensed cannabis retailers, and a universal symbol on the label of authorized cannabis products.

She also signed, in late November , a bill aimed at expanding the hemp market of the state through collaborative partnerships that identify new opportunities for using the crop and derivatives it produces for packaging and construction.

Last month, the New York Senate approved a bill that would provide relief from taxation to New York City cannabis businesses who are currently prevented from claiming federal deductions due to an Internal Revenue Service code (IRS), known as 280E.

Although Hochul signed last year a budget bill that included provisions that allow state-level tax deductions for cannabis businesses — a partial remedy to an ongoing federal issue — New York City’s own tax laws were not affected by this change.
