New Mexico Senate Votes To Keep Marijuana Drive-Thrus Open

On Monday afternoon, New Mexico Senate approved an amendment that allows cannabis businesses to continue offering their services through drive-thru window.

Katy Duhigg, a senator from Albuquerque (D), is the sponsor of Senate Bill 6. This bill would amend New Mexico’s Cannabis Law. The Senate Judiciary Committee had written a substitute bill that would have prohibited the sale of cannabis at drive-thru windows.

On Monday, Sen. Jeff Steinborn of Las Cruces introduced three amendments on the Senate Floor. The first removed the prohibition on drive-thru cannabis and allowed it to remain in place.

Senators argued that the drive-through cannabis sales would eventually result in fatalities.

The Senate approved the amendment with a vote of 21-20, Sen. Ronn Griggs not voting. The Senate passed the bill as a whole in an hour-long vote that was based on party lines.

In its analysis, the New Mexico Department of Health notes that the Bill prohibits the sale and use of cannabis and alcohol in the same location.

Steinborn said he spoke with his local police chief and the head of the state’s Cannabis Control Division, who both told him that they had not had any issues with drive-thru marijuana.

Sen. Joseph Cervantes, D-Las Cruces, cited data from the state Department of Transportation showing that, in 2021 (the latest data available), there were more drug-related fatal traffic accidents than in the five previous years.

Supporters of the drive-thru pharmacy argued that it allows people with disabilities who have limited mobility to get the drug. There are also drive-thrus for other medications.
