Top Things to Know

The marijuana banking act that will be voted on next week is now known as the Secure and Fair Enforcement Regulation Banking Act. It also has revised provisions including a controversial part which had previously stalled committee action. Senate Majority leader Chuck Schumer (D) said that the revised bill would “allow legal cannabis businesses…access” to financial services while letting federal regulatory agencies “stop bad actors.” He will bring the bill to the floor with “all due speed.”

  • Members of the Senate Banking Committee Sens. Kevin Cramer, Jack Reed and Jack Reed (R-ND), in recent interviews, indicated that the disagreements regarding Section 10 of marijuana banking legislation have been resolved before next week’s voting.

House Oversight and Accountability Committee Chair James Comer (R, KY) intends to file an amended that will eliminate key provisions in a bill being voted on by his committee this Wednesday. The original version of the bill would protect people against being denied federal employment and security clearances because they use marijuana. It also provides relief to people who have lost opportunities.


  • A staffer of Rep. Nancy Mace, R-SC, told Marijuana Moment she planned to support Comer’s amendment allowing federal agencies to continue to refuse to hire or issue security clearances for current cannabis users.

New Hampshire’s commission for drafting legislation on legalizing marijuana sales in state-run stores received testimony from state officials regarding a new franchise model for cannabis dispensaries. It is not known if Gov. Chris Sununu, a Republican, is not certain if he would support this plan.

California Gov. Gavin Newsom, a Democrat, is expected to make a decision on 17 marijuana- and drug-policy reform bills before October 14. These include measures that allow cannabis cafes and legalize psychedelics. They also prohibit employers from asking about marijuana use when hiring job applicants.

Ohio Gov. Mike DeWine, the Senate President and other Republicans are against the marijuana legalization measure on the November ballot. However, bipartisan lawmakers do not believe that the state legislature will repeal it if the voters approve the measure on Election Day.

Two ballot initiatives have been filed by a new campaign in Oregon that would reverse some of the decriminalization of drugs approved by voters, reinstituting criminal sanctions for certain substances and other changes.

The United Food and Commercial Workers International Union and an alliance of cannabis trade associations and drugs policy reform groups have sent a joint letter to Congress calling for the passage of a marijuana banking law to combat the “humanitarian cost” of robberies that target cash-intensive businesses.

Missouri colleges and Universities are offering cannabis courses that prepare students to work in the legal marijuana sector.

Two new co-sponsors have been added to the House marijuana banking legislation, bringing it up to 72.
