DeSantis signs bill prohibiting medical marijuana at Florida Recovery Residences even if recommended by doctors

Florida Gov. Ron DeSantis, the Republican candidate for president in 2024 and a member of the Republican Party, signed a law that prohibits residents from possessing or using medical marijuana. This is true even if a patient has been certified by a physician to use cannabis therapeutically according to state law. Other pharmaceuticals prescribed by doctors may still be allowed.

The Governor signed SB 210 on Tuesday. He also gave his final approval for a hemp regulation measure which bans the sale to anyone under 21 of smokeless hemp products.

According to the newly passed SB210 applicants seeking licensing for recovery residences within the Department of Children and Families of the state will have to affirm that the do not allow the use of marijuana, including “marijuana that has been certified as medically used by a qualified doctor.”

The law does not specifically mention medical marijuana, but residents can continue to use other prescription drugs.

A prospective recovery residence must provide documentation to be certified, which includes a manual of policies and procedures. This requirement will be amended by the new law to include a prohibition of marijuana in the manual, regardless of whether a person is a medical cannabis user.

DeSantis also approved SB 1676. This bill revises the hemp regulations of the state, and includes a provision that prohibits the sale to anyone under the age of 21 any smokeless hemp products, such as chewing gum and snuff. The previous law only restricted the sale of smokable items.

He also vetoed a second set of criminal justice reforms that didn’t directly deal with cannabis. The bills would have updated sentencing and expungement laws.

The Governor signed a separate bill this month allowing doctors to renew medical cannabis prescriptions to patients via telehealth. He also took steps to encourage Black farmers to participate in the state’s Medical Marijuana Program.

DeSantis’s marijuana policy statements and actions have been in the spotlight ever since he entered his race, especially after he recently said that would not decriminalize Cannabis if he were elected into the White House.

DeSantis talked about Florida’s medical cannabis program, which was approved by voters. He said that under this model military veterans “actually have access” to marijuana. He said that the issue was “controversial” because some people abuse marijuana and use it recreationally.

In recent weeks, several Republican presidential candidates for 2024 have addressed issues related to drug policy.
