Former top regulator says Nevada Marijuana Consumption Lounges could soon become the industry’s “New Frontier”

Nevada’s marijuana-smoking lounges will be opening soon. The state’s former top regulatory official says that the social consumption facilities may represent “the next frontier of the legal cannabis market” following an extensive rulemaking procedure which laid a solid “foundation” for a marketplace.

Tyler Klimas, former executive director of Nevada Cannabis Compliance Board from 2020 until late 2023, spoke about the future hospitality market in the state during an interview that WeedWonks published last week.

After a yearlong process of setting up rules for consumption rooms, which were legalized by a bill introduced by Assemblyman Steve Yeager(D), former Governor. Steve Sisolak, a Democrat who signed the law into effect in 2021, said that the facilities would be open soon.

He said, “We’ll see them in action.” “It’s an exciting and interesting time to watch what happens in this new sector.”

CCB granted a first batch of licenses to consumption lounges in June after the regulators had approved 40 potential hospitality businesses.

The interview was recorded in November, just before Klimas left office. He acknowledged that consumers and the private sector were eager to open the sector sooner. But he also said regulators had been deliberately methodical in order to ensure success. They held over a dozen meetings in public to include a variety of stakeholders, before finalizing rules, for instance.

The licensees must now “find space to build, obtain local government approvals, and finish their lounges,” Klimas explained.

It’s a new market. He told that there was no blueprint. We see many business projections and plans, but no one really knows unless we open them up. “We don’t yet know how successful the project will be. This is exciting.”

In an email sent to Marijuana Moment on Tuesday, a CCB consumption-lounge program officer said that “we don’t have an exact opening date for the State’s initial consumption lounges.”

Some licensees have provided tentative dates, such as the Las Vegas-based Planet 13 retailer , which plans launch its first “Dazed Lounge”, before the cannabis holiday, 4/20.

The remaining 20 licenses will be granted to existing cannabis retailers who plan to open social use areas. Other 20 licenses were awarded to existing cannabis retailers who planned to open social use areas. The regulators have agreed to limit the number of consumption lounge licenses to 65 for the time being.

Klimas said that the rulemaking process may have taken longer than stakeholders and consumers had hoped for, but it was done this way on purpose. He said CCB was grateful to the legislature for allowing regulators to go through an administrative process in order to set up the sector without having to adhere to overly restrictive statutes or deadlines. This allowed for multiple perspectives to be considered, resulting in a “foundation” of rules that are solid.

The law allows businesses to combine cannabis with yoga, serve food infused with THC, provide THC-assisted massage therapy, or incorporate marijuana other ways.

Sisolak, Nevada’s former governor, praised Nevada’s lounge laws in an op-ed in Marijuana Moment for 2022. He wrote: “The concept is not new, but nobody is doing it as we are in Nevada.”

He said that while most consumption lounges do not offer food, drinks or other entertainment, the lounges in Nevada will provide a one-stop shop for entertainment, creating jobs, growing the industry, and boosting our economy.

According to the rules approved by the board, consumption must remain hidden from view. Smoking or vaping is prohibited in the lounge. Cannabis products that are intended for single-use or those ready to consume cannot be taken off site. Businesses must also provide free water to all guests.

Cannabis will be the only product sold in lounges. Alcohol, nicotine or tobacco products are prohibited.

Lounges are also required to implement plans to reduce the exposure of workers to secondhand smoke and to cannabis impairment. Guns are banned, surveillance is mandatory and procedures need to be put in place to reduce or respond to potentially violent behavior.

The regulations limit the amount of cannabis that can be used in a single-use product to 3.5 grams. “Extracted inhalable products” (such a dabbing or vaping products) are restricted to 300 milligrams THC. All single-use cannabis products that contain more than one gram of usable marijuana, as well as all extracted inhalables must have written warnings about potency.

The maximum amount of THC in edibles that are ready to consume is 10 milligrams. This is a standard dose for states where cannabis has been legalized for adult use.

Topicals are restricted to 400 milligrams THC. Transdermal patches, all cannabis products and other cannabis-based products are limited to 100 milligrams of THC. They must also carry a warning if the product contains more than 10 mg.

The state’s marijuana law changed another significant way in the first quarter of this year. A new policy was implemented that doubled the amount of cannabis a person could buy and possess, to 2.5 ounces.

Retailers who sell recreational cannabis will be able to provide medical cannabis to patients without requiring a separate licence.

The new law was passed as part of a comprehensive marijuana reform bill signed by Gov. Joe Lombardo, a Republican, signed the law into effect in June. The law also expands the eligibility of people with previous felony convictions to participate in the market.

Nevada officials adopted a proposal recently to amend the hiring standards of police officers , allowing job candidates previously disqualified due to marijuana-related crimes to be considered for law enforcement jobs.

In June, the governor signed legislation to establish a new group to study psychedelics as well as develop a plan for regulated access to therapeutic uses. His office staff recently met with activists of psychedelics to discuss how to fill up appointments for that body.

In May, the Nevada State Athletic Commission voted to submit a proposed regulatory amendement to the Governor to protect athletes against being penalized for using or possessing cannabis in compliance with the state law.
