Minnesota Lawmakers Include Psychedelics provisions in Large-Scale Health Bill Going To Floor Vote Soon

Minnesota legislators have attached the provisions of a bill to establish a task force on psychedelics to prepare the state to legalize large-scale omnibus healthcare legislation. This could be brought to the House floor very soon.

Last week, the House Health Finance and Policy Committee approved an author’s amendment that added a revised version from Rep. Andy Smith (D) to the bill.

If approved, the Psychedelic Medical Task Force would advise lawmakers on “the legal and medical issues associated with legalizing psychedelic medicines in the state,” according to the legislation.

It would have to “examine existing scientific studies on the therapeutic efficacy psychedelic medicines in the treatment mental health conditions, such as depression, anxiety, and post-traumatic stress disorder and any other mental conditions or medical conditions for whom a psychedelic medication may be an effective treatment option.”

The plan would address “statutory changes required for the legalization and regulation of psychedelic medicines”

The Ways & Means Committee must approve the Omnibus with the psychedelics language. This could happen as soon as next week, after lawmakers return from recess. The next step for the omnibus with that psychedelics language would be the Ways & Means Committee if it passes through that panel.

The author’s amendment was adopted by committee. It also made two substantive changes to the psychedelics legislation, which was introduced as a standalone bill. The task force will now be limited to psilocybin and MDMA, as well as LSD.

The task force would have previously been instructed to look at mescaline and bufotenine, DMT (5-MeO-DMT), DMT, 5-MeO–DMT, DMT, 2-C-B, ibogaine or salvinorin-A, as well as ketamine.

Last week, the panel also approved the amendment without including any prior committee-approved changes to task force appointment provisions. To increase the bill’s bipartisan appeal the sponsor allowed both the minority and majority leaders to each appoint one of the task force members. This revision was removed in the Omnibus.

“Unfortunately, most drugs got wrapped around the globe on drugs in 1980s. So there are a lot antiquated laws which are stymieing both research and allowing these medications to be used in treatment,” Smith told KIMT TV. The task force’s goal is to find a way to responsibly roll back these regulations.

He said that psychedelics have “incredible potential to help people suffering from depression” and are much more affordable.

The task force of 23 members would include officials and experts such as the governor, a designee and the state health commissioner. Two tribal representatives and people with expertise in substance abuse treatment, public policy experts, veterans with mental illnesses, and others.

It states that the task force will submit two reports to the chair and ranking minorities members of the legislative panels with jurisdiction over human and health services. These reports will detail the taskforce’s findings regarding legalization of psychedelic medicines in the state. They also include the comprehensive plan under subdivision. The first report must be submitted no later than February 1, 2024 and the second by January 1, 2025.

Kurtis Hanna is a registered lobbyist for Minnesota NORML and is working pro bono to promote this bill as a citizen lobbyist. Marijuana Moment was informed by Hanna that the committee’s adoption of the psychedelics amendment to the Omnibus “brings me one step closer to the Minnesota Executive Branch being formally tasked to study the therapeutic potential these substances, which are unfairly stigmatized for too long.”

He said that legal research would be necessary to reduce the risk of Minnesotans being afoul federal law if they have access to these substances in the future session of the State legislature. “This is something that has never been done meaningfully for medical cannabis, which was legalized in Minnesota in 2014.

Hanna stated that “By finally taking these drugs seriously, the members in future legislative sessions can be far more equipped to make decisions related Minnesotans legal access psychedelic medications, potentially paving way for a revolution how mental health in our state is treated.”
