Minnesota Governor Seeks Director For State’s New Marijuana Regulatory Agency to Oversee Legalization Launch

The governor of Minnesota is seeking to hire a director who will oversee the new state marijuana regulatory agency that will be established as a result of a legalization bill he passed last month .

The job listing for the Executive Director of the Office of Cannabis Management was posted on Friday. This is a position held by Gov. Tim Walz, a Democrat, will personally appoint the executive director of the Office of Cannabis Management (OCM). The law will create the office on Saturday, and legal possession for adults as well as home cultivation will be implemented on August 1.

The job description states that “the inaugural director of the Office of Cannabis Management is responsible for building a state agency from scratch and will play a leadership role in setting up and regulating a newly emerging cannabis market in Minnesota.”

The Director will be responsible for planning, policymaking, regulatory functions, including compliance, enforcement and licensing, social equity, tribal relations, legislative relations, and operations management. This position will ensure that office activities are in line with the statutes, rules, and legislation governing Agency.

The responsibilities will include managing day-today operations, managing staff and budgets, directing legislative needs, and developing a regulatory framework that ensures “a safe, accessible, and ethical cannabis industry.” They will also be responsible for licensing compliance, providing leadership in government relationships, tribal relations, and communications.

The applicant must have at least 8 years’ experience in “regulation oversight, public administration or business.”

The posting states that “a bachelor’s or higher degree in public administration, management or a closely related field may substitute for two years experience.”

Two years of management experience is also required, which includes “supervising high-level and professional management staff.” The applicant must have an understanding of “planning, developing and implementing budgets, policies and procedures, and objectives necessary to reach the goals of an organisation or program, along with the development of a strategy plan.”

A prospective director should also have previous experience in a regulatory agency. They must be able to demonstrate strong communication skills and “cultural competency” as well as the ability to embrace diversity.

A prior experience in the cannabis sector is also preferred but not required.

The state Supreme Court, meanwhile, is looking for someone to be a member of a new marijuana expungements Board being created as part of the new legalization legislation. The Cannabis Expungement Board facilitates record sealing for those with marijuana convictions that are eligible.

The board will officially be established on August 1, the day after cannabis possession and home-cultivation are legalized.

In a separate update, the Minnesota Bureau of Criminal Apprehension announced that under the new legalization law, approximately 66,000 cannabis records will be automatically sealed. The Expungement Board of the Department of Corrections will review another 230,000 records.

It will take a little longer to get the first adult-use retailer in the state open.

The state is eager to get the industry up and running quickly. In fact, earlier this month, the governor stated that Indian tribes may be able sell to adult consumers faster than normal licensees.

Before Walz even signed the reform law, the state created a website to serve as a central hub of information on the new law. Officials are also soliciting vendors who can help create a licensing system.

Democratic-Farmer-Labor legislators are pointing to the achievement on cannabis reform as a direct result of voters putting the party in the majority in both chambers after last year’s election.

The bill that passed both chambers was an updated version of the bill passed by the House in 2021. Former Majority Leader Ryan Winkler, (D), served this year as the campaign chairman for the advocacy coalition MN Is Ready .

A recent poll found that 64 per cent of Minnesota’s registered voters supported the creation of a regulated market for marijuana. This included 81 percent among Democrats and 49 percent among Republicans.

Two surveys released in September showed that the majority of Minnesota residents supported adult-use marijuana. One survey also revealed that more Minnesotans approved of the state’s decision to legalize THC infused edibles, which was enacted by the state last year.

In September, a poll conducted by members of the House during the State Fair found that the majority also supported legalization. This legislature-run survey found that 61 per cent of Minnesotans support legalizing cannabis for adults.

The support for legalization was higher this year than in 2021 when the House Public Information Services surveyed fair-goers. The House poll in 2019 found that 56 percent supported legalization.
