Washington State launched an official online portal where people can request reimbursement of legal fees for prosecutions under the drug criminalization laws that The state Supreme Court declared unconstitutional by 2021.
On Saturday, the state Administrative Office of the Courts launched the Blake Refund Bureau Website to help facilitate the relief. This was done in coordination with the courts, county clerks and public defenders.
AOC stated that if you have a Blake criminal record you will need to have any Blake-related convictions removed and your refund eligibility determined by your court of conviction. Once your convictions are vacated, then you can request reimbursements for any Blake-related (legal financial obligations) that have already been paid.
The novel repayment fund is being established in response to the landmark 2021 decision in Washington v. Blake by the State Supreme Court that the criminal code of the state for drug possession crimes were unconstitutionally flawed, because it did not require proof that the person “knowingly” perpetrated the offense. This created a situation in which people could be criminalized even for inadvertently possessing drugs.
The state’s drug criminalization law was effectively thrown out by the ruling. However, the governor signed a bill that the legislature passed, which reinstates the prohibition. It also contains statutory fixes for constitutional muster, and lower penalties for possessing drugs compared to the old law.
There could be some relief for the 350,000 estimated people who were caught in the system of the previous statute.
According to the legislation passed, the state will allocate $47 million for a thorough review of hundreds of thousand records of marijuana possession misdemeanors and felony drug possession. A further $50 million will go to reimburse eligible people for fines, costs and legal obligations.

In addition, a number other reforms to drug policy have also been made in this state’s session.
Gov. In May, Jay Inslee signed into law a bill that will prevent workers from being subjected to employment discrimination because of their lawful marijuana use during the hiring process.
Inslee approved another measure that same month allowing interstate commerce of cannabis in the absence of a change in federal policy.
In May , he also acted on another bill that would promote research into the psilocybin drug and create a program for therapeutic access to psychedelics in mental health treatment. He signed the bill, but he vetoed some sections that “nolonger align with the intent of the bill.”
