Cannabis remains federally illegal. Federal agents can and do seize state-legal cannabis at interior checkpoints, and a federal court upheld that authority in 2026. This guide exists for awareness. It is not a guide to avoiding enforcement.
Where the permanent checkpoints are
The interior checkpoints most travelers meet are on I-25 north of Las Cruces, US-70 west of Alamogordo, US-54 at Orogrande, US-62/180 east toward El Paso, I-10 west of Las Cruces, and US-285 north of Carlsbad. Our community checkpoint map shows current traffic status reports at each.
What agents can do
Checkpoint stops are brief immigration inspections, but agents who develop probable cause may search, and cannabis found is subject to federal seizure. Outcomes range from seizure and release to federal citation.
The 2026 ruling
A federal court confirmed in 2026 that state legalization does not restrict federal seizure authority at these checkpoints. Nothing about a New Mexico purchase receipt changes that.
Our hard rule
Posts advising evasion, concealment, or coordinated transport through a checkpoint are auto-flagged and removed, and repeat attempts get accounts banned. The map is a traffic tool.
